Terms of Service

These Terms of Service ("Terms") govern all repair, diagnostic, installation, and related services provided by Central Minnesota Appliance Repair LLC ("we", "us", "our") to any customer ("you") who books, requests, or receives service from us, whether through centralminnesotaappliancerepair.com, by phone, by text, by email, or in person. By scheduling, accepting, or paying for service, you agree to these Terms.
1. Services and estimates
Diagnostic fees, parts, and labor are quoted before work begins whenever reasonably possible. Estimates are based on the information available at the time of diagnosis. Hidden damage, secondary failures, or parts unavailability may change the final price; we will notify you before performing additional work.
2. Payment
Payment in full is due at the completion of the repair unless other written arrangements have been made. We accept major credit cards, debit cards, and checks. You authorize us to charge the payment method you provide for all amounts owed, including the diagnostic fee if you decline the repair.
3. Disputes must be brought to us first
Any dispute, disagreement, billing question, or concern relating to a credit card charge, debit charge, check, invoice, repair, part, or service must be brought directly to Central Minnesota Appliance Repair LLC first. You agree to contact us in writing at service@centralminnesotaappliancerepair.com or by phone at (651) 364-7466 and give us a reasonable opportunity (no less than thirty (30) days) to investigate and resolve the issue before initiating any chargeback, stop-payment, bank dispute, public complaint, lawsuit, or other proceeding.
You agree not to file a credit card chargeback, ACH reversal, or stop-payment on a check as a substitute for contacting us. Doing so is a material breach of these Terms.
4. Mandatory binding arbitration
If we cannot resolve a dispute informally under Section 3, you and Central Minnesota Appliance Repair LLC agree that the dispute must be resolved by final and binding arbitration, and not in court, except as expressly provided below. This includes any claim arising out of or relating to these Terms, our services, payments, warranty, advertising, or any interaction between you and Central Minnesota Appliance Repair LLC.
- Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, by a single arbitrator, in Minnesota, or by another mutually agreed neutral arbitrator.
- You must commence arbitration before filing any court action and must not deviate from the arbitration process once started. The arbitrator's decision is final and binding.
- Each party is responsible for its own attorneys' fees and costs except as the arbitrator may award.
- Class action waiver. All claims must be brought in your individual capacity, not as a plaintiff or class member in any purported class, collective, or representative action.
- Either party may bring a claim in small-claims court for matters that qualify, or seek injunctive relief in court to protect intellectual property or to enforce an arbitration award.
By using our services you knowingly and voluntarily waive your right to a jury trial and to participate in a class action against Central Minnesota Appliance Repair LLC.
5. Chargebacks, stopped checks, and consequences
Filing a credit card chargeback, ACH reversal, or stop-payment on a check without first completing the informal-dispute process in Section 3 and the arbitration process in Section 4 is a breach of these Terms. If you initiate a chargeback or stop a check on a valid invoice, you agree that:
- You will be added to our Do Not Service list and we may refuse all future service at any address associated with you or your business.
- We may report the unpaid balance to collections and to consumer- and business-credit reporting agencies.
- You will be liable for the full unpaid invoice amount, plus any bank, processor, NSF (returned check), collection, and chargeback-defense fees we incur, plus interest at the maximum lawful rate under Minnesota law.
- We may file a mechanic's lien, statutory service lien, or other lien against the residence, business, or other real property where the service was performed, to the fullest extent allowed by Minnesota law.
- After exhausting the arbitration process required in Section 4, we may seek court remediation to enforce the arbitration award, foreclose any lien, or collect amounts owed, and you agree to pay our reasonable attorneys' fees and costs in any such action.
Returned or stopped checks are also subject to the statutory civil penalties and service charges allowed under Minnesota Statutes § 332.50 and § 604.113.
6. Warranty
Our workmanship and parts warranty is described on our Warranty Policy page and is incorporated into these Terms by reference. The warranty is void if the invoice is unpaid, charged back, or stopped.
7. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or relating to the services is limited to the amount you paid us for the specific service giving rise to the claim. We are not liable for consequential, incidental, indirect, special, or punitive damages, including lost profits, food spoilage beyond the limits stated in our Warranty Policy, or property damage not directly caused by our negligence.
8. Governing law and venue
These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws principles. Subject to the mandatory arbitration clause in Section 4, the exclusive venue for any permitted court proceeding is the state or federal courts located in Hennepin County, Minnesota, and you consent to personal jurisdiction there.
9. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of our services after a revision constitutes acceptance of the updated Terms.
